Q: Should I just take What the insurance company is offering for my settlement?
A: First and foremost, remember…the insurance company for the at-fault person has their own legal team. Their goal is to pay as little as possible and as soon as possible to get the case settled. However, it makes good sense to attend a free consultation to make sure you are getting the best settlement. True story: I met with an injured policeman who was considering accepting a $100,000.00 policy limits offer. He met with me and I discovered two more liability insurance policies and his case finally settled for $250,000.00. The original insurance company did not inform him of the additional coverage for obvious reasons.
Q: Do I really need an attorney, or can I just settle the case myself?
A: If your claim involves property damage only with no injuries, you may not need an attorney if you can both agree upon the amount. Any claim involving injuries is a different story altogether. There may be amounts to be paid back to a health insurer; there may be issues of permanency or disfigurement that cause your claim have a greater value. You must remember the liability insurer and you have competing interests, you are adverse to one another.
You want the highest reasonable value for payment of your claim. The insurance adjuster wants your signature on a Release and to pay as little as possible for your claim. I do not recommend it.
